Jackson
County, Oregon Register of Article XV, Section 5 of the
Oregon State Constitution provides that "The property and pecuniary rights
of every married woman, at the time of marriage or afterwards, acquired
by gift, devise, or inheritance shall not be subject to the debts, or
contracts of the husband; and laws shall be passed providing for the
registration of the wife’s separate property."
Few Oregon women took advantage of the additional layer of protection that actual registration offers; below is a transcription of the entire register, preserved in the offices of the Jackson County Clerk. A photocopy of the manuscript register is available at the Rogue Valley Genealogical Society's Jackson County Genealogical Library, under the title "Married Women's Property Rights." Declaration of Mrs. Ann Rogers to hold separate property I hereby declare that it is my firm and full intention to hold in my own right, separate and apart from my husband or any other person, the following described property, to wit: Three promissory Notes bearing date June 1st A.D. 1859, calling for the payment of Five hundred dollars each, due in twelve months from date or sooner if certain moneys are disbursed by the Indian Superintendency. Also one note calling for the payment of Three hundred and twenty five dollars and in all other respects like the above described notes--All the above notes [are] signed and payable by Patrick Flanagan and were given to me in payment for my donation claim of land. The above described property and proceeds thereof it is my full and firm intention to hold in my own right and convert to my own use. and benefit, the following described property, to wit: Parts of Lots
numbered one (1) and Two (2) in Block No. Twenty seven (27) in the Town
of Jacksonville, Jackson County and State of Oregon, said Lots situated
on the South east corner of Oregon and Main Streets fronting Thirty
feet on said Oregon Street and running back seventy six feet on Main
Street, being the same property conveyed to me by John Anderson
& wife by Deed bearing date the twelfth day of July A.D. 1859
and recorded in the Recorder's Office of Jackson County Oregon in
Record Volume 2 Page 349. And I hereby declare it to be my full

under the Act of the Legislative Assembly of Oregon, approved June 4th

Know all men by these presents that I Eliza Ann Hoxie of the County of Jackson and State of Oregon, do hereby declare my intention to hold in my own right, separate and apart from my husband or any other person whomsoever, and for my separate use and benefit, the following described real estate, to wit: The East half of a half section tract of public land, known and designated in the Surveys and plats of the United States as the Claim No. 54 in Township 38S. of Range 1 West, Willamette Meridian, more particularly described in the donation Certificate No. 483 granting to Obadiah D. Henderson of Jackson County, Oregon, wife of Stephen J. Henderson of the same place do assert and declare that I am the owner in my own right of both real and personal property and estate in said Jackson County and State of Oregon which I hold and claim, possess and occupy as my individual and separate estate and interest and in no way subject to the control or disposal of my said husband or for or on his account, which said property is described as follows to wit: The East half of the half section of land claimed and now occupied by the said Stephen J. Henderson and the above claimant under and by virtue of the laws of the United States of America granting and donating Public Lands to actual settlers in the State of Oregon, being the same premises upon which the claimant is now residing in Jackson County State of Oregon and by this claimant supposed to be the East half of the South half of Section Eight (8) in Township Thirty seven (37) South of Range number One (1) West, of Willamette Meridian of the State of Oregon, but the description by number is uncertain and now out of the actual recollection of claimant. Also the following described personal property Consisting of Cattle and horses on the range at or near the residence of this claimant or within Jackson County aforesaid, viz: of Cattle, Eighteen head of American Milch Cows at Mr. Stearns east of Jacksonville, with their calves a lot of Muleys or hornless cattle running in the band of said Stephen J. Henderson and being all of that description belonging to said band. The Cow known as the Lill Cow or bell Cow with all of her increase. Two Cows called the Richey Cattle and all of their increase, running near Gold Hill; One Cow known as the Lane Cow and her increase, including a heifer with broken horn all supposed to be ranging on Lane Creek. The Cattle known as the "Blackey Stock." The Sam Mace blackey & her increase being a spotted four year old Cow and calf & a white speckled three year old Cow and Calf--lined backed two year old heifer and their increase. One white faced brindle Cow and increase--a five year old Cow and their increase. One cow brockled one horn lower than the other. One red Cow the increase of the muley stock of Cattle some white on her back with her increase. One white speckled Cow known as "Pett" and her increase the oldest being a speckled young Cow with a calf; the increase of the Cows at Stearns. Two roan bulls being the blackey stock of Cattle. The Cow known as the Widow blue and her increase four in number; All Cattle known as the Hamlin Marked a Cross & slit in the right and an under slope in the left ear. The Cow known as the "Lize Cow" and her increase about eight in number; One cow called "broken horn" and her increase about six in number; Four Cows known as the white flag and their increase about nine in number. One red white faced cow called the Morgan Cow. The "Mahogany Cow" and her increase and the increase of the increase (two of them yellow with white faces) about eight in number. The "Rockfellow Cow" and her increase including a black cow and her increase and a black heifer & her increase and a four year old Steer. The Ryecraft Stock of Cattle; All of the above Cattle being branded in the brand of the said Stephen J. Henderson SH on the right hip, ear marks on some of various kinds some with crop off the right ear & hole in the left ear--and some of them marked with the mark of this claimant in addition, being a small slit in the cropped ear. Also of Horses, the following; A young bay mare had of Burns of Gasburg with her colt. One bald faced Indian Mare with ear marks with yearling Colt and a sucking Colt. One bay mare known as "Flora Milner" and her two Colts. That all of said before described estate & property is the result of my own estate by care, management & increase; except the donation of said parcel of land by the Government as before stated. That the said stock is ranging with the cattle & Stock of my said Husband and this declaration is made to protect me and my heirs in the same and the ownership, use, enjoyment, or disposal thereof in my own right as by law provided. A. Z. Jones, P. Gilfeather and William Sutherland, the same being one third of the undivided interest and water privilege owned jointly by P. Gilfeather J. A. Z. Jones and myself by said Deed of gift from Elijah Chaney, also One third interest in the Cabin occupied by P. Gilfeather; Also one half interest in the fluming privilege taken up and recorded by J. A. Z. Jones, situated in the Willow Springs Gold Diggings in Jackson County State of Oregon. The same being acquired partly by gift, prior to my marriage, from my Father and the rest being acquired by purchase from my own funds. Also, (1) Lot of hogs consisting of (16) sixteen head (12) twelve of which are marked with (2) two under bits in the right and one in the left ear; and (3) three of which are marked with a crop and slit in the right and under bit and slit in the left and the other with an under bit in each ear. All of the above hogs were acquired by gift from my Father since my marriage. The difference between the mark which my husband puts on his Cattle, and those owned by me is that he does not put a slit in the right ear, as I do mine. I received as my part of my mother's estate, about five years ago, the sum of two hundred and thirty dollars; I received as a gift from my father two cows and one mare and mare colt at the time I was married, which was about the year 1884. I have since purchased other property with said money and by exchanging property, and am now the owner of the following described property, all being in the County of Jackson, State of Oregon, to wit: About 50 head of cattle branded M. on the left hip, a dewlap on brisket, cut down, marked swallow forked in right ear and under slope in left ear--and about 25 head of horses branded M on left shoulder. I did not receive any of said property by any gift from my husband, John J. Murphy, and I claim to own and do own the same in my own right.
